Welcome to Made By Fans (“App”, “Service”, “we”, “us”), operated by Lubab LTD, a company registered in the United Kingdom (“Company”). By installing, accessing, or using the Made By Fans application through the Shopify App Store or via custom integration, you (“Merchant”, “User”) agree to be legally bound by these Terms of Service. If you do not agree to these terms, do not install or use the Service.
1. Description of Service
Made By Fans provides e-commerce merchants with automated and manual workflows to invite verified purchasers to record video and text testimonials. The Service includes customer-facing recording pages, video encoding and storage via Mux, administrative review queues, consent tracking, and discount reward fulfillment.
2. Merchant Responsibilities & Advertising Compliance
As a merchant utilizing our Service, you agree that:
- Truth in Advertising: You will comply with all applicable advertising laws and regulatory guidelines (such as the United States Federal Trade Commission (FTC) Guides Concerning the Use of Endorsements and Testimonials, and UK ASA regulations).
- Clear Incentives: If you offer incentives (e.g., discounts, gifts, or store credit) in exchange for video reviews, you must clearly disclose such incentives as required by regulatory authorities.
- Content Moderation: You are responsible for reviewing customer submissions and ensuring published content does not infringe on third-party copyrights, trademarks, or contain defamatory or unlawful material.
3. Intellectual Property & Video Licenses
Customer Submissions: When a customer submits a video through Made By Fans, they grant the merchant a license to use the content based on the explicit checkboxes selected during submission:
- Publishing Consent: Permission to display the video and customer name on the merchant’s store and marketing channels.
- Advertising Consent: Permission to utilize the video in paid media, advertising campaigns, and social media promotions.
Right to Revoke: If a customer withdraws their consent, you agree to promptly cease using the video in active advertising and mark the submission as revoked within the Made By Fans admin.
4. Subscription Billing & Plan Quotas
Made By Fans offers tiered monthly subscription plans (Basic, Grow, Advanced). All subscription fees are billed through Shopify’s official Billing API and appear directly on your regular Shopify invoice.
- Monthly Video Quotas: Each plan provides a fixed monthly video submission limit. Unused submission allotments do not roll over to subsequent months.
- Upgrades & Downgrades: You may change your plan at any time via Shopify Admin. Billing adjustments are prorated according to Shopify’s billing rules.
- Cancellation: You may cancel your subscription at any time by uninstalling the application from your Shopify Admin. No refunds are provided for partial billing periods once a cycle has commenced.
5. Video Retention & Storage Policy
To optimize infrastructure costs, video files are maintained on streaming servers according to the retention window of your active tier (30 days for Basic, 90 days for Grow and Advanced). Merchants are encouraged to download ad-ready MP4 files during the active retention window. After the retention window expires, media files are removed while signed consent records remain permanently accessible.
6. Disclaimer of Warranties
The Service is provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, whether express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or compatible with every mobile device browser.
7. Limitation of Liability
To the maximum extent permitted by applicable law, Lubab LTD, Made By Fans, and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities arising out of or related to your use of the Service. Our total aggregate liability under these terms shall not exceed the amounts paid by you to Made By Fans in the three (3) months preceding the claim.
8. Termination
We reserve the right to suspend or terminate access to the Service for any merchant that violates these Terms, uses the platform for unauthorized spam, or engages in fraudulent activity. Upon app uninstallation, all webhooks will trigger automatic data cleanup pursuant to our Privacy Policy.
